All photography, images, videos, written content, graphics, logos and other creative materials produced and published by MatfromNi’s Photography are protected by copyright and intellectual property laws.
Unless otherwise stated, all original photographic works are the exclusive intellectual property of MatfromNi’s Photography / Matthew Hamill.
1. Ownership of Photography
All photographs taken by MatfromNi’s Photography remain the copyright and intellectual property of the photographer unless a separate written agreement states otherwise.
Purchasing a photography service, digital photograph or physical print does not automatically transfer copyright ownership to the customer.
Copyright remains with MatfromNi’s Photography unless it has been expressly assigned or transferred in writing.
2. Personal Use
Where photographs have been supplied for personal use, customers may:
Download and store their purchased photographs.
Print photographs for personal use.
Share photographs on personal social media accounts.
Use photographs as personal wallpapers or displays.
When sharing photographs online, customers are encouraged to credit MatfromNi’s Photography where reasonably possible.
3. Prohibited Use
Unless written permission has been provided, photographs may not be:
Sold, sublicensed or redistributed.
Used for commercial purposes.
Used in advertising or promotional material.
Submitted to competitions, publications or third-party websites for commercial benefit.
Altered, edited, filtered or manipulated in a way that misrepresents the original work.
Used to create derivative products for sale.
Claimed as the work of another photographer or individual.
Uploaded to stock photography websites or image libraries.
4. Commercial Use
Any commercial use of photographs requires prior written permission from MatfromNi’s Photography.
Commercial use may include, but is not limited to:
Business advertising.
Marketing campaigns.
Websites belonging to businesses or organisations.
Promotional materials.
Printed advertising.
Product packaging.
Paid social media advertising.
Publications and magazines.
Merchandise or products for sale.
A separate commercial licence or usage agreement may be required depending on the intended use.
5. Editing and Alteration
Customers may not significantly alter, manipulate or edit photographs without permission.
Minor adjustments for personal social media use, such as cropping to fit a platform's required dimensions, may be permitted provided the photograph is not otherwise misrepresented.
MatfromNi’s Photography reserves the right to request the removal of an altered photograph if the alteration damages, misrepresents or negatively affects the photographer's work or reputation.
6. Social Media
Customers are welcome to share photographs provided to them for personal use on their personal social media accounts, subject to any specific restrictions agreed at the time of booking.
Where reasonably possible, photographs should be credited to MatfromNi’s Photography.
Social media sharing does not transfer copyright ownership to the person sharing the photograph.
7. Website and Portfolio Use
MatfromNi’s Photography may use photographs taken during photography sessions for its portfolio, website, social media, advertising, promotional material and other business purposes where appropriate and where this has been agreed with the client or permitted under the applicable agreement.
Where photographs involve identifiable individuals, any required permissions or agreements will be obtained where necessary.
Clients may request that particular photographs are not used for promotional purposes, subject to the terms agreed for their photography session.
8. Copyright Infringement
Unauthorised copying, reproduction, distribution, commercial use or other unauthorised use of photographs may constitute copyright infringement.
Where unauthorised use is identified, MatfromNi’s Photography reserves the right to request that the material is immediately removed and may pursue any other remedies available under applicable copyright law.
This may include seeking appropriate compensation for unauthorised use.
9. Copyright Notices and Watermarks
Copyright notices and watermarks must not be removed from photographs supplied by MatfromNi’s Photography without permission.
Removing a copyright notice, watermark or other identifying information does not transfer ownership or grant permission to use the photograph.
10. Copyright Transfer
Copyright will only be transferred to another person or organisation where a specific written copyright assignment has been agreed and signed by the relevant parties.
Unless such an agreement exists, MatfromNi’s Photography retains ownership of the copyright.
11. Third-Party Content
Some content displayed on the website may belong to third parties. Such content remains the property of its respective copyright owner and may not be reproduced or used without appropriate permission.
12. Reporting Copyright Infringement
If you believe that your copyrighted material has been used on this website without permission, or that material belonging to MatfromNi’s Photography has been used without authorisation, please contact MatfromNi’s Photography with details of the alleged infringement.
Where appropriate, MatfromNi’s Photography will investigate the matter and take reasonable steps to resolve the issue.
13. Changes to This Policy
MatfromNi’s Photography reserves the right to update or amend this Copyright Policy from time to time.
Any changes will be published on this page, with the "Last Updated" date amended accordingly.
